2. Petitioner has been made accused in connection with Lawalong P.S. Case No. 52 of 2024 corresponding to POCSO Case No. 83 of 2024 for the offences registered under sections 87, 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 8 of POCSO Act, pending in the court of learned Special Judge, POCSO, Chatra.
3. Petitioner is alleged to have enticed away the minor daughter of the Informant to leave her lawful guardianship with the intention to marry her.
4. Statement of the victim recorded under section 183 of the B.N.S.S., earlier called for, has been received, from perusal of which, it appears that the victim has stated that the petitioner has established physical relationship with her.
5. Victim is aged 16 years. Her consent for physical relationship is immaterial.
6. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected.
