This application under Section 482 Cr.P.C. has been filed seeking quashing of the impugned order dated 01.11.2010 passed in Criminal Case No. 336/12/2008 (Jagdish Sharan Agrawal vs. Dr. Jagdish). 3. The brief facts of the case are that in the instant case father of the opposite party no.3 had filed an application under Section 156 (3) Cr.P.C. against the applicant herein, upon which the direction was issued to registration of the F.I.R. Thereafter, the matter was investigated by the police and the final report was submitted against the applicant herein. On protest being filed by the opposite party no.2 by the impugned order dated 01.11.2010, the said protest was allowed and further investigation was directed in the matter. 4. On the first date of appearance none appeared on behalf of the applicant to press the instant application. Subsequently, when the matter was listed the matter was directed to be listed in due course. Since then, the matter could not be listed and is listed today. Therefore, looking at the nature of order passed more than 15 years ago, in the considered opinion of this Court nothing survives in the matter. 5.
