The short grievance of the petitioners is non removal of the encroachments made in the cart track situated in Kanakaveedu Village, Nandavaram mandal, Kurnool District. 2. Heard Sri T.Venkata Manoj, learned counsel representing learned counsel for the petitioners, Sri M.Sudhir, learned Standing counsel for Gram
Panchayat and Sri Chandrasekhar, learned Assistant government pleader for Revenue. 3. Learned counsel for the petitioners in elaboration to what has been stated in the affidavit contended that, there is a cart track abutting to the petitioners’ agricultural fields and they are using the said cart track as ingress and egress to their fields. He further contended that, some encroachers have encroached the said cart track affecting the ingress and egress of the petitioners to reach their agricultural lands. He further submitted that, inspite of making representations requesting the authorities to remove the encroachments, no necessary action was initiated by the respondent authorities. As such prayed to pass appropriate orders protecting the interest of the petitioners. 4. Though the matter is of the year 2023 and despite granting sufficient time, the respondents neither got instructions nor filed counter and sought further time in that regard. 5. As the relief sought by the petitioners is innocuous, this Court is inclined to dispose of the writ petition without inviting counter, with the following directions:
“The Gram Panchayat concerned shall take steps for removal of encroachments, if any made in the cart track situated in Kanakaveedu Village, Nandavaram mandal, Kurnool District in accordance with law by issuing show cause notices to all the concerned parties inviting explanation
by giving reasonable time and to pass a reasoned order after providing an opportunity of being heard and communicate the same to all the parties concerned in accordance with law within three(03) months from the date of receipt of copy of this order.
If no encroachments were found as alleged by the petitioner, the Gram Panachayat shall inform the same to the petitioner in writing.”
Accordingly, the writ petition is disposed of. No costs. Miscellaneous applications, pending if any, shall stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI
