Case No. 160 of 2024, for the offences registered under Sections 85, 89, 74, 351(2) & 3(5) of BNS, pending in the court of learned C.J.M., Pakur, Jharkhand. Petitioner happens to be the husband of the prosecutrix, who was driven away from her matrimonial home to enforce the demand of dowry. It was submitted that petitioner has earlier filed original suit before the Court of Principal Judge, Family Court, Pakur under Section 281 of the Mohammadan Law for restitution of conjugal right on 22.11.2024 and subsequently, this case was filed. It was further submitted that the prosecutrix has not sustained any injury at the hands of the petitioner. Learned A.P.P on behalf of the State has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Pakur, Jharkhand, in connection with Maheshpur P.S.
