State of HP and Anr. Vs. Karnail Singh CMP(M) No.2402 of 2025 Item No.D-7 28.07.2026 Present: Ms. Priyanka Chauhan, Deputy Advocate General, for the appellants/State. Mr. Ashwani Pathak, Sr. Advocate with Mr. Dev Raj, Advocate, for the respondent. The present application for condonation of delay in filing the present appeal by 326 days is preferred by the State. The order passed by the learned Single Judge was of dated 18.11.2024 and the certified copy of the same had been received in the office of the Executive Engineer on 28.12.2024. On 09.08.2024, the learned Civil Judge had directed to implement the award dated 12.08.2013, passed by the Labour Court-cum-Industrial Tribunal. The Executive Engineer, JSV Division Chowari submitted the complete case to the Superintending Engineer on 21.05.2025 and the liability for actual benefit was calculated @ Rs.31,00,000/-. Reference is also made to the other cases pending on similar facts. Reply has been filed to the present application and from the perusal of the same, it is evident that a sum of Rs.31,05,670/- had been paid by the department on 17.12.2025. Keeping in view the above, we are of the considered opinion that delay is liable to be condoned, as the State had been dealing with two Courts at the same time. Accordingly, the application is allowed and delay is condoned, subject to payment of Rs.10,000/- as costs to be paid to the respondent-workman on or before the next date of hearing.
