GP FOR HOME The Court made the following Order: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate Writ, Order, or Direction more particularly in the nature of Writ of Mandamus, declaring the action of the respondents in opening and continuing the Rowdy history sheet in proceedings C.No.127/HS-0/DSO-NDG/21 Dt. 22-11-2021 against the petitioners and calling the petitioners to the police stations without issuing any summons, notices or memos and harass them in the name of counseling and making them to wait in the stations every time without any reference to time on the day when called or taken police stations without any or specific purpose as the same is arbitrary, illegal and without jurisdiction and voilative of Art 14 and 21 of the constitution of India and to pass”. 2. Heard Sri P.Prabhakar Rao, learned counsel for the petitioners and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners would submit that no crime is pending against the petitioners. 4. Learned Assistant Government Pleader for Home would submit that as per the counter affidavit, one crime No.14 of 2016 vide SC No.86 of 2016 on the file of ASJ Court, Nandigama, is pending against the petitioners. 5. In reply, learned counsel for the petitioners would submit that the matter was compromised before the Lok Adalat and as of now no case is pending against the petitioners but the police are continuing the rowdy sheet. 6. Recording the said submissions, and in view of the fact that there are no cases pending against the petitioners, the writ petition is allowed and the Rowdy Sheet opened against the petitioners is hereby set aside. There shall be no order as to costs.
