PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A2, A3, A5 and A6, seeking regular bail, in Crime No.93 of 2024 of Koyyuru Police Station, Alluri Sitharama Raju District. 2 2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 and 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that on 29.09.2024, at about 16.00 hours, the Sub-Inspector of Police, Koyyuru Police Station, along with his staff and mediators, while conducting vehicle checking at the outskirts of Koyyuru Mandal, found one auto rickshaw bearing registration No.AP 31 TE 9823 coming from Budaralla village side. On seeing the police, when they tried to escape, the police chased them and caught hold four persons. Police seized 110 KGs of Ganja from them under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The quantity of contraband allegedly seized from the possession of the accused is 110 Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor 3 submits that the case is still under investigation and some more witnesses are to be examined. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners herein. 6.
