By way of the instant petition, the petitioner is seeking a direction from the State Government to take over the School namely ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.12 10:28:49 +0530 2 / 3 Ashashkiye Ucchttar Madhyamik Vidyalaya, Robretson (Chaple), Tahsil Kharsiya, District Raigarh, run by the society namely Gramin Shiksha Vikas Samiti, Robertson (Chaple), Tahsil Kharsiya, District Raigarh, C.G. 2. The grievance of the petitioner is that though on the earlier occasions petitioner has preferred the writ petitions the first petition was filed before the erstwhile High Court of Madhya Pradesh at Jabalpur bearing W.P. No.5139 of 1997 which was disposed of with a direction to the State Government to reconsider the representation made by the petitioner for taking over the School with all its assets and liabilities vide order dated 18/11/1999, however, despite that the representation of the petitioner was kept pending. Thereafter, again the petitioner filed another writ petition bearing WP No.1085 of 2002 before this Court which was disposed of directing the respondent authorities to decide the representation, however, the representation of the petitioner was not decided. The petitioner again filed a petition bearing WPC No.1291/2018 which too was dismissed as withdrawn with liberty to press the representation in light of the earlier order passed by this Court in WP No.1085 of 2002, however, the representation of the petitioner has not yet been decided. Hence this petition. 3. Learned counsel for the petitioner at this juncture would confine his prayer to the extent that the respondents No.1 to 6 may be directed to decide the representation of the petitioner and comply the direction 3 / 3 issued by the Respondent No.3 dated 25/04/2024 (Annexure P/5) within a stipulated time frame. 4. Learned State counsel would contend that they have no objection in deciding the representation of the petitioner. 5. I have heard learned counsel for the parties at length and perused the documents with utmost circumspection. 6. Considering the limited prayer made by learned counsel for the petitioner, it is directed that the Respondents No.1 to 6 shall decide the representation of the petitioner or Respondent No.6 shall comply the direction issued by the Respondent No.3, in accordance with law. 7. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall proceed on its own merits. 8.
