PUBLIC PROSECUTOR The Court made the following order: The Criminal Petition has been filed under Section 439(1) of Cr.P.C and Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.34 of 2025 of G.K. Veedhi Police Station, Alluri Sitharama Raju District, registered for the alleged offence punishable under Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2 Dr.YLR, J Crl.P.No.11524 of 2025 2. The learned counsel for the petitioner submits that the petitioner is unable to comply the conditions imposed by the learned Trial Court while he is enlarged on bail. The financial condition of the petitioner is deplorable. 3. Heard the learned Counsel for the Petitioner/Accused No.1 and the learned Assistant Public Prosecutor. Perused the record. 4. The petitioner was allegedly found in possession of 28 Kgs of Ganja. 5. Considering the facts and circumstances of the case, vide the order dated 10.09.2025 passed in Crl.M.P.No.989 of 2025 by the I Additional District & Sessions Judge, Visakhapatnam is modified the Petitioner/Accused No.1 shall be released on bail on his execution of bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for like sum to the satisfaction of the Court of Judicial Magistrate of First Class, Chinthapalli. The remaining conditions imposed in Crl.M.P.No.1168 of 2024 shall be complied with. 6. Accordingly, the Criminal Petition is disposed of. ________________________ DR. Y.
