GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a Writ of Mandamus declaring the action of the respondent Nos- 3 and 4 in not conducting the fair/proper investigation, failed to trace out of the Bore Well Drilling lorry vehicle bearing No. KA 51 MD 5677 in Crime No. 450 of 2021 dt- 28.07.2021 and thereby issuing the notice dt- 02.12.2021 under section 91 of Cr.P.0 to the petitioner to produce witnesses, for further investigation, and to declare the same as highly illegal, arbitrary, contrary to provisions and rules contained in Code of Criminal Procedure, and also opposed to the settled principles of law, and Consequently direct the 3rd and 4th respondent to conduct the fair/proper investigation, and trace out the Bore Well Drilling lorry vehicle bearing No. KA 51 MD 5677 belongs to the petitioner pertaining to Crime No. 450 of 2021 dt- 28.07.2021, in the interest of justice.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, after conducting investigation in Crime No.450 of 2021 of Kadiri Town Police Station, Anantapur, the Police referred the matter as “Civil in Nature”. 3. Learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
