By the present application filed under Section 483 (3) of the Bharatiya Nagarik Suraksha Sanstha, 2023, the prosecution seeks cancellation of bail granted by this Court on 24/06/2025 in Criminal Bail Application (BA) No. 559 of 2025, mainly on the ground that, subsequent to registration of Crime No.211 of 2025 for the offence punishable under Sections 3(1)(ii), 3(2) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999 (MCOC), stand invoked. 3. Learned counsel appearing for the non- applicant / accused has placed on record copy of judgment and order dated 19/08/2026 passed by the Division Bench of this Court in Criminal Writ Petition Nos. 544 and 595 of 2026, whereby the order dated on 28/08/2025 passed by the Additional Commissioner of Police, invoking the 2 10appln101.2025.odt provisions of the MCOC Act, has been quashed and set aside. 4. Since the Division Bench of this Court has quashed and set aside the order passed by the Additional Commissioner of Police, North Region, Nagpur City, invoking the provisions of Section 3(1)(ii), 3(2), 3(4) of the MCOC Act, 1999, and therefore, grounds set out by the prosecution in the present application for revocation of the bail does not survive.
