PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1 to A4, seeking regular bail, in Crime No.163 of 2024 of Kothakota Police Station, Anakapalli district. 2 2. A case has been registered against the petitioners herein and another for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 29.10.2024, at about 15.00 hours, on credible information about transportation of Ganja, the Sub-Inspector of Police, Kothakota Police Station, along with his staff and mediators, proceeded to Dondapudi Forest Check-post and, while conducting vehicle checking, they found A1 to A4 in possession and illegal transportation of 40 Kgs of Ganja in a Car bearing registration No.KL 67 C 0134 coming from Kalyanapulova and proceeding towards Kerala. A1 to A4 confessed about the involvement of A5 in the present crime. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 40 Kgs of Ganja was seized from the possession of the petitioners herein/A1 to A4 on the date of incident, which is a commercial quantity. It is submitted by the learned Assistant Public 3 Prosecutor that the case is still under investigation and some more witnesses are to be examined and A5 has to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners/A1 to A4. 6.
