2025:UHC:2088-DB HIGH COURT OF UTTARAKHAND AT NAINITAL HON’BLE THE CHIEF JUSTICE MR. G. NARENDAR AND HON’BLE SRI JUSTICE ALOK MAHRA 24TH MARCH, 2025 WRIT PETITION (CRL) NO.238 OF 2025 Manju Devi …...Petitioner Versus State of Uttarakhand & others …….Respondents Counsel for the Petitioner : Mr. Avidit Noliyal, learned counsel. Counsel for the State : Mr. J.S. Virk, learned Deputy Advocate General with Mr. R.K. Joshi, learned Brief Holder. JUDGMENT :(per Mr. G. Narendar, C.J.) Heard learned counsel for the petitioner and learned Deputy Advocate General for the State. 2. Learned counsel for the petitioner would submit that the petitioner had preferred a PIL alleging therein misuse of the Gaon Sabha land; that on account of which, the vested interests, who have been taking undue advantage of the situations, were angered by the petitioner’s action of bringing the illegalities to the notice of the Court; that there was an attempt to assault her and this Court had directed grant of protection to the petitioner in WPCRL No.402 of 2023. 3. Now the petitioner alleges that, subsequently, the villagers have engaged outsiders to attack and harm the petitioner. 4. Per contra, learned Deputy Advocate General 1 2025:UHC:2088-DB would submit that the petitioner was given protection and was under the watch of local police station for quite a long time from 2023, and as the police were of the opinion that the threat perception had considerably reduced or vanished, the protection was removed. 5. He submits that the jurisdictional SHO will once again assess the threat perception and take action accordingly, and if necessary, security would be ensured to the petitioner. 6. The submission of learned Deputy Advocate General is placed on record. 7. The writ petition is disposed of. 8. Registry is directed to forward a copy of this order to the concerned SHO forthwith. 9. As a sequel thereto, pending application, if any, shall stand closed. ________________ G. NARENDAR, C.J. _____________ ALOK MAHRA, J. Dt: 24th March, 2025 NISHANT 2
