HON'BLE THE CHIEF JUSTICE MR. MANINDRA MOHAN SHRIVASTAVA HON'BLE MR. JUSTICE SAMEER JAIN Judgment 14/02/2025
1. The present petition has been filed assailing the order dated 23rd March, 2022, passed in DB Civil Special Appeal (Writ) No.639/2020, whereby the appeal, filed by the appellant, was dismissed.
2. On perusal of the review petition, the following facts are revealed: 2.1 That the present petition is barred by the provisions of the Limitation Act, 1963 as the same has been filed with a lapse of 270 days. 2.2 That the review petition is filed in form of a disguised appeal stating various grounds on merits. Therefore, it can be
[2025:RJ-JP:6679-DB] (2 of 2) [WRW-25/2023] deduced that the same is filed as a review petition, with grounds as that of an appeal, in order to overcome the delay.
3. In light of the above, the present review petition is deemed to be dismissed, as the same is not only barred by the principles of Limitation Act, 1963, and has been filed after an absurd delay of 270 days, but also is assailing a detailed order dated 23rd March, 2022, which has already confirmed the order dated 26th October, 2009, passed by Rajasthan Civil Services Appellate Tribunal, Jaipur which itself is a detailed speaking order. Thence, the prayer made herein cannot be considered.
4. Accordingly, the present review petition is dismissed. Pending applications, if any, shall stand disposed of.
