CORAM:
HON'BLE MR. JUSTICE HARPREET SINGH BRAR Present: Mr. M.S. Kathuria, Advocate for the petitioner. Mr. Vikas Bhardwaj, AAG, Haryana. Mr. Kamal Deep Sehra, Advocate for the complainant.
HARPREET SINGH BRAR, J. (ORAL) The present petition has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking anticipatory bail in case bearing FIR No.148 dated 06.03.2025 (Annexure P-1) under Sections 191(3)/190/115(2)/109/351(2)(3)/126(2) of BNS registered at Police Station Yamuna Nagar City, District Yamuna Nagar, Haryana.
Learned counsel for the petitioner inter alia contends that the perusal of the FIR (supra) clearly indicates that the petitioner has not given any specific injury on the person of the complainant on his head. He refers to the FIR (supra) and submits that co-accused, namely, Ram, has given an iron rod blow on the head of Zia Abbas. Thereafter, co-accused, namely, Honey, Raju and Nepali, picked up bricks from the spot and gave injuries on the head of Zia Abbas, as such, the petitioner cannot be held liable for the injuries which have been declared dangerous to life. CRM-M-18607-2025 -2- Per contra, the learned State counsel assisted by learned counsel for the complainant submits that petitioner is the main accused and has acted in a premeditated and determined manner and petitioner has first of all held the complainant and forcibly put him in his car and, thereafter, when the mother of the complainant came forward to rescue him, the petitioner along with others have given her slap blows. In the present case, the injured, namely, Zia Abbas has not recovered till date and he went in coma and now he is bed ridden. Having heard learned counsel for the parties and keeping in view role attributed to the petitioner in the present case, his custodial interrogation is required, therefore, no ground is made out to grant anticipatory bail to the petitioner and thus, the present petition is hereby dismissed.
