HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MRS. JUSTICE SHUBHA MEHTA Order 17/10/2025 This habeas corpus petition has been filed by the petitioner, who is husband of the corpus. Counsel for the petitioner submits that the corpus, a married lady aged about 37 years, has been missing for the last one month and was allegedly kidnapped by private respondent No.5.
[2025:RJ-JP:42592-DB] (2 of 2) [HC-385/2025] Heard counsel for the petitioner and perused the material available on record. Upon careful examination of the facts and circumstances of the case, it is observed that the petitioner has failed to furnish any substantive proof or evidence in support of the claim of kidnapping or illegal detention of the corpus by any person. It is further noted that the corpus is a major adult woman, capable of making her own decisions. In the absence of any credible material indicating illegal detention or wrongful confinement, this Court finds no ground to entertain the present habeas corpus petition. In that view of the matter, the present habeas corpus petition stands dismissed.
