ORAL ORDER Heard Sri Manohar, advocate for Sri S.Nagaraja, learned counsel for the petitioner/wife.
2. Petition is filed under Section 24 of the Code of Civil Procedure with the following prayer:
“WHEREFORE, it is prayed that this Hon’ble Court be pleased to withdraw M.C.No.1226/2024 pending before I Addl. Principal Judge, Family Court at Mysore produced at Annexure-C and transfer the same to Prl. Judge, Family court at Bengaluru, to try and dispose off in accordance with law and pass such other orders that this Hon’ble Court deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity.”
3. Respondent/husband has filed a petition for divorce on the file of the I Addl. Prl. Judge, Family Court, Mysuru. Respondent has sought for dissolution of marriage solemnized with the petitioner on 04.04.2001 at Gayathri Temple, Yaswanthapura, Bengaluru.
4. Petitioner/wife has sought for transfer of the said petition from Mysuru to Bengaluru on the ground that respondent has

threatened her with dire consequences if she attends the court at Mysuru.
5. Respondent/husband is represented by Sri Arun Gadag, advocate. However, he has not chosen to file vakalath, despite copy of the petition being served on him.
6. As such, this Court heard the learned counsel for petitioner/wife.
7. Petition relief cannot be granted on two grounds.
8. Firstly, case gets disposed of effectively before the Mysuru Court at an early point of time having regard to the pendency of the cases at Bengaluru.
9. Secondly, since the video conferencing facility is now available, petitioner/wife can avail the said facility effectively and, successfully participate in the proceedings at Mysuru Court.
10. If an application is filed by the petitioner/wife seeking permission to participate in the proceedings through video

conferencing, learned Trial Judge at Mysuru is hereby directed to allow the said application.
11. With that observation, the following:

Petition dismissed.
