Respondent(s) PRAYER :-This writ petition has been filed under Article 226 of the Constitution of India for issuing a writ of mandamus directing the Respondents to disburse 6% interest for belated payment of Provident Fund, gratuity and also consequently direct the respondents to pay the unsettled benefits of earned leave salary, leave encashment amount and last 7days salary within the stipulated time. Pradeep For Respondent(s): Mr.K.Raja, S.C., 1/4 https://www.mhc.tn.gov.in/judis WP No. 18729 of 2025 ORDER The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to disburse interest at the rate of 6% p.a. towards belated payment of provident fund, gratuity,leave surrender and the unsettled benefits of last 7 days salary. 2. The learned counsel for the petitioner would submit that he was working as a driver from 04.04.1993. Though he was retired from service on 28.02.2018 on attaining the age of superannuation as Selection Grade Senior Driver, the retirement benefits were settled only on 03.11.2018 and no interest has been paid for the delayed period. Therefore, for the interregnum, he is entitled for interest. 3. It is the further submission of the petitioner that apart from the settlement of the above terminal benefits, still the respondents has to settle last 7 days salary of the petitioner. In this connection, the petitioner has sent a representation on 14.03.2025 to the respondents. But the same has not been considered so far. 4. In view of the same, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 14.03.2025, and pass orders within a period of six weeks from the date of receipt of a copy of this order, on merits and in accordance with law. 6. With the above directions, this writ petition is disposed of.
