30.04.2025 DL-59 Ct. No. 33 Srimanta In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side WPA 21423 of 2019 Din Mahammad Khan -Vs.- State of West Bengal & Ors. Mrs. Susmita Dey (Basu) …for the petitioner. Mr. Suddhadev Adak …for the respondents. The petitioner had retired from service as an ‘operator’ on 28th February, 2015. He had received a sum of Rs.6,24,917/- as a consolidated sum against payment of gratuity and leave encashment on 25.02.2016. The grievance of the petitioner is the failure on the part of the respondent authority to grant interest for delayed payment of gratuity after nearly a year from the date of superannuation. The learned Advocate representing the respondent authority considered to the same. The respondent nos. 2 to 4 is, therefore, directed to pay interest at the rate of 6% per annum from 29.02.2015 till 25.02.2016 on Rs.9,43,654/- within four weeks from the date of communication of this order. 2 Accordingly, the writ petition being WPA/21423/2019 is disposed of.
