Invoking jurisdiction of this Court under Article 226 of the Constitution of India, the petitioners herein have filed this writ petition calling in question legality, validity and correctness of order dated 22.08.2025 (Annexure P-1), passed by the Central Administrative Tribunal (for short the ‘Tribunal’), Jabalpur Bench Circuit Sitting at Bilaspur in Original Application No.O.A./819/2025, whereby the learned Tribunal has rejected the interim application filed by the petitioners. 2. Learned counsel for the petitioners submits that the interim order has been granted by the Tribunal in the matter of Sashwat Upadhyay Vs. Union of India, in Original Application No.672/2014 dated 17.01.2025 which relates to the post of Assistant Administrative Officer, and in the matter of Deepti Sharma Vs. AIIMS in Original Application No.796/2025(Jabalpur), dated 22.08.2025 which relates to the post of Technical Officer (MLT), therefore, interim order may also be passed in this petition also. 3. Learned counsel for the respondent No.1 opposed the submission made by learned counsel for the petitioners and submits that the challenge in the instant petition relates to the post of Senior Nursing Officer whereas the interim order has been passed in the case of post of Technical Officer, therefore, both are different. Thus, the recruitment process for the said post may not be stayed. 4 4. After having heard learned counsel for the parties, and after going through the records, we do not consider it to be a fit case to interfere with the interim order dated 22.08.2025 passed by the Tribunal. However, any promotion made during the pendency of the original application shall be subject to final outcome of the original application. 5. The Tribunal is further directed to expedite the hearing and disposal of the Original Application pending between the parties. 6. Accordingly, the instant petition stands disposed of.
