The 5 th respondent's mother Mrs.N.Kalayani w/o.Narayanasamy operated a saw mill by name N.K.V.Saw Mill at Agarakadambanur, Kilvelur Taluk, Nagapattinam District without valid license or approval. The 3 rd respondent order closure through proceedings dated 23.05.2013, based on government regulations prohibiting unlicensed sawmills established before and after 30.10.2002. The said Kalyani filed WP.No.17999 of 2013 before this Court, this Court directs her to submit a fresh application under Rule 4 of the Tamil Nadu Regulation of Wood Based Industries, 2010. The 5 th respondent mother was allotted with house site patta for residential purposes, which was misused to operate the sawmill.
The 5 th respondent did not secure necessary approvals from local authorities, the no objection certificate was obtained by the pollution control board was allegedly obtained fraudulently and the issuing officer was later arrested for unrelated fraudulent activities. The said Kalyani sought licence renewal under Rule 5 using false information and fabricated documents. The 4 th respondent issued license (C.No.2055/2021/A1, License No.8/2022, dated 10.05.2022) in violation of norms. The petitioners submitted 3/7 https://www.mhc.tn.gov.in/judis
W.P.No.14459 of 2025 representations dated 14.05.2022 and 07.10.2023 to the authorities, stating the irregularities and requesting an investigation and cancellation of the license. In the meanwhile, the said Kalyani died during the month of December 2024, and now the 5 th respondent is in continues operation of the sawmill. Hence, the present writ petition. 3. Mr.S.Rajesh, learned Government Advocate takes notice for the respondents 1 to 4. The learned Government Advocate appearing for the respondents 1 to 4 would submit that the representations of the petitioner dated 14.05.2022 and 07.10.2023, will be considered on merits and in accordance with law, within the time frame stipulated by this Court. 4. Heard the learned counsel for the petitioners and the learned Government Advocate appearing for the respondents 1 to 4 and perused the materials available on record. 5. W.P.No.14459 of 2025 petitioners dated 14.05.2022 and 07.10.2023, by conducting detailed enquiry, after giving due notice to the petitioners and the 5 th respondent, opportunity of personal hearing to both the parties, to consider the documents filed by the petitioner as well as by the 5 th respondent, on merits, in accordance with law, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. 6.This writ petition is disposed of, with the above observations and directions. No costs. Consequently, connected miscellaneous petition is closed.
