JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 14-08-2025 Heard learned counsel for the parties. 2. This petition has been filed for modification of order dated 16.01.2023 passed in Cr. Misc. No. 53830 of 2022 to the extent of reduction of interim maintenance amount from Rs. 8,000/- to Rs. 3,000/- per month on the ground that petitioner is unemployed and is not in a position to pay the aforesaid fixed amount. 3. However, learned counsel for the informant opposes the petition and submits that from perusal of the impugned order, it is apparent that the interim maintenance amount was fixed on the basis of undertaking given by the Patna High Court CR. MISC. No.37513 of 2025(2) dt.14-08-2025 2/2 petitioner himself and as such, the same cannot be modified on the ground of unemployment or inability. 4. In view of the aforesaid facts and circumstances, order dated 16.01.2023 passed in Cr. Misc. No. 53830 of 2022 is not required to be modified. This modification petition is, accordingly, dismissed.
