Sri B.V.Rama Rao, learned counsel for the Petitioner would submit that, aggrieved by the
judgment of conviction in C.C.No.353 of 2018 on the file of the Court of III Addl.J.F.C.Magistrate, Kakinada for the offence under Section 138 of N.I.Act, the Petitioner filed Crl.A.No.214 of 2025 on the file of the Court of III Addl.District & Sessions Judge, Kakinada, wherein, he was granted suspension of sentence vide Order dated 16.07.2025 in Crl.M.P.No.471 of 2025 on the condition of depositing 20% of the compensation within 30 days.
Learned counsel for the Petitioner would further submit that, as the learned Appellate Judge dismissed the petition filed for enlargement of time to deposit 20% compensation amount, he filed the present criminal petition, wherein, this Court vide Order dated 20.11.2025 granted three weeks time therefrom, to deposit the said amount.
It is further submitted that, due to the ill- health of the Petitioner, he could not approach his counsel at Kakinada and thereby delay of one
day occurred in depositing the said amount. The Petitioner deposited the amount on 11.12.2025 and filed the original FDR along with a memo to that effect on 12.12.2025 before the trial Court. The learned trial Judge returned the same, on the ground that the time granted this Court was elapsed. There are no willful laches on the part of the Petitioner.
Considering the submissions made, this petition is allowed. Time for filing the FDR along with memo, before the trial Court, is extended for a period of one week from this day. ________ Dr.VJP, J Note: Issue C.C today B/o. Dinesh
