ORDER This Court, by order dated 26.09.2024 in CRP.(NPD).No.3090 of 2019,
directed the petitioner to deposit the entire rental arrears of rent within a period of six weeks from today and shall continue to deposit the rents on or before 10 th of every succeeding months i.e., rents upto September 2024 shall be deposit to the credit of RCOP. No.1059 of 2005, within a period of six weeks and rent for October 2024 shall be paid on or before 10 th November and so on, without fail and such deposit shall be made without prejudice to the rights and interest of the present owner of the property.

Learned counsel for the petitioiner submitted that due to the delay in receiving the certified copy of the order, the petitioner could not deposit the rental arreats to the credit of R.C.O.P.No.1059 of 2005 before the Lower Court and the petitioiner's payment was rejected by the Lower Court, stating that time is barred. Therefore, the petitioner has filed the above Civil Miscellaneous Petition, seeking to extend the time to deposit the arrears of rent as directed in C.R.P.(NPD).No.3090 of 2019, dated 26.09.2024. https://www.mhc.tn.gov.in/judis

Considering the submissions made by the learned counsel for the petitioiner, time is extended by a period of eight weeks from today, and the petitioner shall continue to deposit the montly rents on or before 10 th of every succeeding months to the credit of RCOP No.1059 of 2005, before the concerned Court, failing which, it will amount to wilful default.
