K.S.P.A.B.R Dam (3rd call) Vide M. Book No. 79 HLC and 61 HLC, with interest of execution and completion of Irrigation works under Irrigation Department as per agreement, to the petitioner till today and causing heavy loss with interest even though total work was completed as per the agreement as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and consequentially to direct the respondents releasing the final bills of total amount worth of Rs. 1,87,29,725/- for execution of completion of Irrigation works under Irrigation Department as per agreement to the petitioner forthwith and to pass such IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents releasing the Final Bill amount of Rs. 1,87,29,725/- for execution of completion of O&M Irrigation works under Irrigation Department as per agreement to the petitioner forthwith, pending disposal of the above writ petition and to pass such

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declare the inaction on part of the respondents herein not releasing the final bill amount worth of Rs. 1,87,29,725/- in respect of its Agreement No. 41 /2018-19, for the work Rehabilitation of K.S. Today, when the matter came up for hearing, learned Assistant Government Pleader for Irrigation furnished a copy of instructions of the Executive Engineer, HLC Division, Ananthapuramu, vide letter No.EE/HLC/ATP/DB/ATO/F:D2/791M, dated 08.12.2025, wherein it is stated that the bill amounts were already paid to the petitioner on
30.09.2025. The details of the payments are as under:-

In view of the fact that the entire amount due was already credited to the petitioner’s RBI-linked bank account on 30.09.2025, this Court is of the opinion that no further cause of action survives for adjudication in the present writ petition. 4. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
