The instant writ petition is preferred under Article 226 of Constitution of India seeking direction to the respondent no.2 to transfer the investigation and submit the police report in Case Crime No.0037 of 2025 under Section 85, 103 (1) of Bhartiya Nyay Sahnita, 2023, Police Station Airport, Commissionerate Prayagraj, which is pending before the respondent no.3. 3. Learned counsel has prayed for issuance of suitable direction for fair and impartial investigation. 4. Learned A.G.A. submits that the police authorities are under obligation to do the investigation fairly, impartially and expeditiously. He apprised to the Court that the investigation is going on and the same would be concluded at the earliest, in accordance with law. 5. The present petition is disposed of directing that the investigation must be ensured in free and fair manner. In case the petitioner is aggrieved, he would be at liberty to move an appropriate application before the Competent Authority i.e. Police Commissioner, Prayagraj. 6. It is made clear that this Court has not expressed any opinion on the merits of the case and the Competent Authority/Investigating Officer to act strictly in accordance with law. (Anil Kumar-X, J.)
