**** HARPREET SINGH BRAR J. (Oral) Present petition has been filed under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 seeking permission to the petitioner to travel abroad for a period of 9-10 months to meet his wife during the pendency of appeal i.e. case No. CRA-450 of 2023 in FIR No. 98 dated 25.02.2015 (Annexure P-1) under Sections 323, 341, 452, 506 and 34 of Indian Penal Code, registered at Police Station Manimajra Chandigarh.
Learned counsel for the petitioner, after arguing for some time, wishes to withdraw the present petition and seeks liberty to approach the learned lower Appellate Court for the same relief as claimed in the present petition before this Court, at the first instance. In view of the above, present petition stands dismissed as withdrawn with liberty as aforesaid.
