JUSTICE RAJESH SEKHRI, JUDGE ORDER 02.09.2025 Vide order dated 21.05.2025, petitioners came to be directed by J&K Special Tribunal, Jammu [“the Tribunal”], to consider the regularisation of violation, if any, in accordance with the enabling provisions of the J&K Unified Building Bye-Laws, 2021 within a period of one month, after undertaking fresh measurements and taking into consideration the factum of building permission dated 07.12.2011 issued for the portion of land measuring 1826 sq. ft., as also the existence of dilapidated triple story building existing on the aforesaid land as per sale deed dated 07.09.2016. Mr. Mayank Gupta, learned counsel for the petitioners has informed this Court that petitioners have not considered the matter pursuant to the aforesaid order and seeks some time to do the needful. Having regard to the limited nature of controversy, the present petition is disposed of with a direction to the petitioners to consider the matter, in the light of the impugned order dated 21.05.2025, passed by the Tribunal within a period of six weeks from the date copy of this order is made available.
