At the end of the Status Report, it has been stated that the defacto- complainant, namely, Amrik Singh, was interrogated and his statement was recorded under Section 161 of the Cr.P.C. as well as the same was video graphed. In course of the interrogation, the defacto-complainant stated that he has entered into an amicable settlement in respect of the monetary dispute and is prepared for termination and settlement agreement which was previously submitted before the Hon’ble High Court. It has also been recorded that, at present, the defecto-complainant has no further allegation against the FIR named accused persons. In view of the joint compromise petition filed by the petitioner and the private respondents and, also considering the nature of the allegations complained of which stems out from private dispute, particularly, the monetary transactions as also the fact that no element of public policy is violated with regard to the criminal case for which investigation is being carried out by the CID, WB, I am of the view that inconsonance with the settled proposition of law, further continuation of the proceedings are unwarranted, as such, Baranagar P.S. Case No. 258 of 2024 dated 25.06.2024 under Sections 406/420/465/467/471/120B of the IPC is hereby quashed. Accordingly, CAN 1 of 2025 is Allowed. With the aforesaid observations, WPA 23783 of 2024 is disposed of. Pending application(s), if any, is also disposed of.
