HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 11254 of 2025 Court No. - 40 HON'BLE SARAL SRIVASTAVA, J.
HON'BLE AMITABH KUMAR RAI, J.
1. Heard learned counsel for the petitioner and learned Standing Counsel for the State.
2. The petitioner by means of the present writ petition has prayed for the following relief:-
"i. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to take appropriate action on the application filed by petitioner dated 18.03.2025 pending before him, within stipulated period as fixed by this Hon'ble Court. ii. Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper under the circumstances of the case, so that justice be done. iii. Award the cost of the writ petition to the petitioner."
3. The grievance of the petitioner is that she has purchased a land from the respondent no.3 and her name has been recorded in the revenue records, but the respondent no.3, who is a private person, is not giving possession of the plot to the petitioner despite the fact that he has executed the sale deed and name of petitioner has been mutated in the revenue records.
4. Be that as it may, the dispute is essentially a private dispute between petitioner and respondent no.3 for which, writ petition is not the proper remedy.
5. Accordingly, the writ petition is dismissed with liberty to the petitioner to avail other alternative remedy available under the law.
