PURKAYASTHA Order 04/02/2025 This contempt petition has been preferred through a legal aid counsel by the petitioner who is an ex-Anganwadi Worker superannuated on 30.04.2018. Thereafter, she pursued a litigation for counting of 50% of her past service in WP(C) No.1138/2019. The matter travelled to the learned Division Bench of this Court. In WA No.206/2020, a Coordinate Bench of this Court affirmed the order passed in the writ petition and dismissed the State’s appeal holding that 50% of the period which the petitioner served as Anganwadi Worker will be added towards her qualifying service for the purposes of pension and other retiral benefits. Such benefit should accrue within 3(three) months from the date of the order dated 03.12.2020. She has preferred the contempt petition after almost more than 4 years of the order passed by this Court alleging that the order has not been complied with. Specific averments are however lacking in the contempt petition or in the representation made before the concerned respondent-authorities such as Annexure-7 dated 18.11.2024. In such circumstances at this stage since the matter relates to pension, though it is considerably delayed, we deem fit to dispose it of with a simpliciter observation that the concerned respondent- authority should consider her representation in line with the directions passed by the learned Writ Court in WP(C) No.1138/2019 as affirmed in WA No.206/2020 with certain more observations. It is expected that due consideration would be made to the representation of the petitioner in accordance with law within a reasonable time. The instant contempt petition is disposed of with the aforesaid observations. Pending application(s), if any, shall also stand disposed of. (S.D.
