The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the entire proceedings of complaint case No. 4114 of 2016 as well as cognizance/summoning order dated 10.1.2025, whereby learned magistrate took cognizance under Sections 420, 120-B, I.P.C., Police Station Kasna, District Gautam Budh Nagar, pending in the court of Additional Chief Judicial Magistrate, Court No. 2, Gautam Budh Nagar. Learned counsel for the applicant submits that the case has been withdrawn by the complainant against the applicant before the trial court, therefore, the case has become infructuous.
