The petitioner has been made accused in connection with Chatra Sadar P.S. Case No. 53 of 2023 (N.D.P.S. Case No.12 of 2024), for the offences registered under Sections 18, 22 and 29 of the N.D.P.S. Act, pending in the court of Sri Shambhu Lal Shaw, learned Principal District Judge-cum-Special Judge, N.D.P.S. Act, Chatra. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.9614 of 2024 by order dated 22.11.2024. On 07.03.2023, Chatra Sadar police apprehended this petitioner and on search, 2.800 Kgs. of opium were recovered from his possession. Quantum of seized opium comes within the purview of commercial quantity. Learned counsel for the petitioner submitted that petitioner is in custody for more than a year. It was further submitted that several witnesses have been examined and there is vital contradiction in the statement of the witnesses. Considering the fact that commercial quantity of opium was recovered from the possession of the petitioner, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall expedite the trial. (Ambuj Nath, J.) Jay/-
