R CHANDRA REDDY The Court made the following: 3 :: ORDER :: Heard Sri A.Kishore Kumar, learned counsel for the petitioner and Sri R.Chandra Reddy, learned counsel for the respondents. 2. The above contempt case was filed complaining about the violation of the docket order dated 03.12.2024 in W.P.No.28329 of 2024. 3. The petitioner filed the aforementioned writ petition to declare the action of the respondents in not promoting him to the post of Joint Registrar, which fell vacant on 30.04.2024, as illegal and arbitrary. 4. The writ petition was listed on 03.12.2024. The docket proceedings of the Court read as follows: “Heard Sri A.Kishore Kumar, learned counsel for the petitioner and Sri Y.V.Anil Kumar, learned Standing counsel for respondent No.3. Learned counsel for the petitioner would submit that respondent No.3 is going to conduct DPC tomorrow i.e., on 04.12.2024, to effect promotions to the post of Joint Registrar. Learned standing counsel, on instructions, would submit that DPC will not be constituted tomorrow and when DPC is constituted, the case of the petitioner will also be placed before the DPC.” 5. Sri A.Kishore Kumar, learned counsel for the petitioner, contended that in the 80th Board Meeting held on 13.09.2024, a resolution was passed constituting the DPC and thereafter, the members were identified by proceedings dated 19.10.2024. The meeting was scheduled to be held in the Second Week of December. However, to deprive the petitioner of the benefit of promotion, the DPC was convened on 30.12.2024, thereby violated the order passed by this Court. 6. Counter-affidavits were filed by respondents 1, 2 and 4, wherein it was specifically contended that no DPC was constituted. It was stated that only a Board Meeting was held on 30.12.2024. 4 7. Thus, as seen from the counter-affidavits of the respondents, no DPC was constituted as of today. The docket proceedings dated 03.12.2024 would indicate that whenever the DPC is constituted, the case of the petitioner shall also be placed before the DPC. 8. Learned counsel for the petitioner further contended that pending the above contempt case, the petitioner retired from service on attaining the age of superannuation and as such, the respondents deprived him to discharge duties as Joint Registrar. 9. However, this Court is not persuaded by the said contention in the above contempt case. The petitioner can pursue the said contention in the writ petition. [ 10. Given the docket proceedings dated 03.12.2024, this Court does not find any violation. 11. Accordingly, the contempt case is dismissed. No costs.
