PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.2 & 4 on bail in Crime No.151 of 2025 of Balajinagar Police Station, Nellore District, was registered against the Petitioners/Accused Nos.2 and 4 herein for the offences punishable under Sections 121(1), 121(2) and 109(1) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’) and under Section 8(c) read with Section 20(b)(ii)(C) of the 2 Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. The allegation against the petitioners/accused Nos. 2 and 4 is that they were involved in dealing with 22 kilograms of ganja, which constitutes a commercial quantity. Accused No. 2 was arrested on 29.08.2025. He has been in judicial custody for the past 60 days. Accused No. 4 was arrested on 23.08.2025. He has been in judicial custody for the past 66 days. The petitioners/accused Nos. 2 and 4 are alleged to be the suppliers of the contraband. The roles of the petitioners came to light based on the confession statement of accused No. 1. There are four adverse criminal antecedents reported against accused No.2. Of course there are no adverse criminal antecedents reported against the accused No.4. According to the prosecution, accused No. 1 was driving the car in which 22 kilograms of ganja were being transported. The inventory process is yet to be completed. There are three injured in this case. One suffered grievous injuries and two suffered simple injuries. It is alleged that accused No.1 drove the car with an intention to kill the police officials who attempted to intercept the vehicle carrying the commercial quantity of contraband. So far, only five witnesses have been examined, and the investigation is still at a nascent stage. The request to 3 enlarge the petitioners on bail is not found convincing and reasonable at this juncture. Hence, the Criminal Petition is liable to be dismissed. 4.
