ORDER:
The instant Criminal Petition, under Section 528 of B.N.S.S., 2023 (u/s.482 of the Code of Criminal Procedure, 1973) has been filed by the Petitioner, seeking quashment of the proceedings of the Sub-Divisional Police Officer, Adoni, vide. C.No. 55/SDPO-ADN/2023, dated: 20.03.2023.
2. Heard Sri Ratan Mohan, learned counsel for the petitioner and Ms. K.Priyanka Lakshmi learned Assistant Public Prosecutor representing the State.
3. The petitioner challenges the deletion of Accused Nos. 6 and 7 from the charge sheet in Crime No. 7 of 2023, dated 21.01.2023, by the Sub- Divisional Police Officer, Adoni, vide C.No. 55/SDPO-ADN/2023, dated
20.03.2023. The petitioner learned counsel for the petitioners would submit that Accused Nos. 6 and 7 were present at the scene of the incident on 20.01.2023 and actively participated in attacking the complainant and his family members, including sprinkling chili powder and assaulting them with sticks and other weapons and deletion of their names from the charge sheet is unwarranted without proper inquiry or notice.
4. Learned Assistant Public Prosecutor is in attendance and would submit that the court may pass appropriate orders.
5. In that view, the criminal petition is disposed of. However, petitioner is at liberty to work out his remedy before appropriate forum in accordance with law.
Pending applications, if any, shall stands closed.
