By way of the instant petition, the petitioner has prayed for the following reliefs:- ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.16 18:47:48 +0530 2 / 3 (i) That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to make payment of compensation as per market value in accordance with compensation act with 18% interest within stipulated time, in the interest of justice. (ii) That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to pay compensation amount in lieu of acquiring land with interest after date of acquired land, in the interest of justice. (iii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted. 2. The instant petition has been filed for seeking a direction towards the respondent authorities to consider the application of the petitioner and pay compensation along with interest to the petitioner on account of acquisition of land bearing Khasra No.132/19, area 0.049 Hectare, situated at Jagdalpur, P.H. No.5, District Bastar, C.G., which came under submergence in construction of Drain. 3. Learned counsel for the petitioner would contend that though the land of the petitioner has been acquired and though the Respondent No.4 has issued letter to Respondent No.5 dated 29/04/2024 with regard to payment of compensation to the petitioner in lieu of acquisition of his land, however, no compensation has been granted to the petitioner. He would next contend that the petitioner has made representation dated 16/04/2024 (Annexure P/1), however, the same is pending and nothing has been done till date. 4. Learned State counsel would submit that they have no objection in deciding the representation of the petitioner, however, the petitioner may be directed to give afresh representation. 3 / 3 5. I have heard learned counsel for the parties and perused the documents. 6. Considering the submissions made by learned counsel for the parties and the issue involved in the present writ petition, the petitioner is directed to file afresh representation along with the all the relevant documents before the Respondent No.3 within a period of 15 days from the date of receipt of copy of this order and in turn the Respondent No.3 shall decide the representation of the petitioner in accordance with law. Further Respondent No.4 shall decide the application filed by the petitioner dated 16/04/2024 (Annexure P/1) filed under Section 13 of the Act, 2013 expeditiously. Let both the above directions issued by this Court shall be complied with within an outer limit of six months from the date of order passed by this Court in the instant writ petition. 7.
