Vinitha For Respondent in all CRPs : Mr.O.Raman COMMON ORDER These Civil Revision Petitions are filed challenging the common order passed by the III Addl. Labour Court, Chennai in allowing the petitions filed by the respondents/employees seeking to reopen the evidence on the employees side, recall their evidence and also to receive the additional documents produced on the side of the employees. 2. The facts of the case leading to filing of the present Civil Revision Petitions are as follows: (i) The respondents herein/employees of the petitioner/Management have raised industrial dispute by filing OPs against the petitioner /Management before the III Addl. Labour Court, Chennai challenging the order of illegal retrenchment passed by the petitioner /Management and also to reinstate them in service with full back wages, continuity of service and all other attendant benefits. https://www.mhc.tn.gov.in/judis CRP No. 5592 of 2025 __________ Page10 of 14 (ii) During trial in the Original Petitions, the respective employees/respondents were examined as WW1 and exhibits Ex.W1 to Ex.W32 have been marked and on the side of the petitioner/Management, the petitioner was examined as MW1 and exhibits Ex.M.1 to Ex.M.23 were marked. The evidence on the employees/respondents’ side was closed on 30.05.2022. (iii) After closing of evidence on both sides, the employees/respondents have filed interlocutory applications in pending Original Petitions praying to reopen, recall the evidence of WW1 and to receive additional documents produced on the side of the employees. They sought for receiving additional documents such as work order, production plan, job cards, tax invoice and daily man power details maintained by the petitioner/management stating that those documents are vital documents and most relevant for proper and complete adjudication of the matter. (iv) The Labour Court, after considering the arguments advanced on either side, allowed the petitions to recall, reopen the evidence on the side of employees/respondents and to receive the documents subject to proof and relevancy. Challenging the order passed by the Labour Court in allowing the petitions to recall, reopen the evidence of employees/respondents and to receive the documents, the present Civil Revision Petitions have been preferred. https://www.mhc.tn.gov.in/judis CRP No. 5592 of 2025 __________ Page11 of 14 3. Heard the learned counsel appearing for the petitioner/Management and the learned counsel appearing for the respondents/employees. 4.The learned counsel appearing for the petitioner/Management would submit that the respondents/employees, during the progress of the trial in original petitions, the employees in the respective OPs have filed Interlocutory Applications seeking for reopening and recalling the evidence on their side and for reception of the additional documents produced by them and the same were allowed in their favour. Challenging the same, the present Civil Revision Petitions have been filed. 5. Learned counsel for the petitioner further submitted that the grievance of the petitioner Management in receiving additional documents marked by the respective employees is simply on the ground that the company is not in existence at the relevant period of time. The respondents/ employees have created the documents for the purpose of the case and they sought permission to mark the documents which is impermissible one. However, learned counsel for the petitioner, after elaborate arguments, submitted that this court may permit the petitioner Management to file a petition for recalling the petitioner/Management’s witnesses for marking the additional documents in order to disprove the documents marked by the respective https://www.mhc.tn.gov.in/judis CRP No. 5592 of 2025 __________ Page12 of 14 employees/respondents. 6. Learned counsel appearing for the respondent/employees would submit that the respondent employees is entitled to establish their case before the trial court, thereby, they filed I.A. for recalling the employees evidence and for marking additional documents and the same was elaborately considered by the Labour Court and allowed the petition, which need not be interfered with. Thus, he prayed for dismissal of the Civil Revision Petitions. 7. Heard the learned counsel for the petitioner/Management and the learned counsel appearing for the respondents/employees and perused the materials available on record. 8. The facts of the case is not in dispute. During the progress of trial in the Labour Court, the respective employees filed interlocutory applications seeking to reopen and recall the evidence of WW1 and to receive additional documents produced on the side of the employees and the same were allowed by the Labour Court on the ground that since it is a labour dispute and for better and complete adjudication of the matter, it is necessary to grant opportunity to the employees to produce the documents in their custody and the petitioner/management is at liberty to cross examine the employees/respondent to test the veracity of the documents. https://www.mhc.tn.gov.in/judis CRP No. 5592 of 2025 __________ Page13 of 14 9. This Court is of the view that if at all the petitioner/Management is having any grievance with regard to the documents marked by the respective respondents/employees, the petitioner Management can very well file similar application before the labour Court disputing the documents already marked by the respective respondents/employees before the Labour Court. Liberty is also granted to the petitioner/management to file application for reopening, recall and marking additional documents on the side of the petitioner/ Management. If such application is filed, the Labour Court is directed to allow the applications filed by the petitioner/Management and dispose of the cases as early as possible. 10. With the above direction, these Civil Revision Petitions are disposed of. No costs.
