1. This writ petition has been preferred under Article 226 of the Constitution of India seeking following reliefs:

“10. Reliefs Sought: (i) That, this Hon'ble Court may kindly be pleased to Quash and set aside the impugned order dated 12.08.2025 passed by the respondent no.02 (ANNEXURE P/1) whereby the interim stay was dismissed; (ii) That, this Hon'ble Court may kindly be pleased to quash the work order dated 25.06.2025 issued in favor of respondent no.05. (ANNEXURE P/2). (iii) That any other order/relief which this Hon'ble Court may deem fit, proper, and just in the facts and circumstances of the present case may also kindly be awarded to the petitioner in the ends of justice.”

Learned counsel for the petitioner contended that vide Advertisement/Letter No.33/POA./Μ.Β.V./2025-26 dated 09.04.2025, respondent/Office of District Programme Officer, Women and Child Development Department, Surajpur, invited applications for manufacture and supply of ready-to-eat fortified flour for Anganwadi Centres in the Surajpur District. The petitioner as well as respondent No.5 submitted their applications with all requisite documents and participated in the said advertisement. Upon evaluation, the petitioner was awarded 84 marks and got first position whereas respondent No.5 secured 81 marks and placed at second position, however, concerned Authority has issued the work order for manufacture and supply of ready-to-eat fortified flour for Anganwadi Centres in favour of the respondent No.5.
To which, petitioner has filed an objection and, thereafter, appeal as well as application under Section 52 of the Chhattisgarh Land Revenue Code, 1959 for grant of interim stay before the concerned Commissioner, however, vide order dated 12.08.2025 (Annexure P-1) his application has been rejected/dismissed in a very mechanical manner and without assigning any reason. Hence,
3 petitioner has came-up before this Court with aforesaid prayer. 3. Learned State Counsel contended that since the appeal of the petitioner is still pending before the concerned Commissioner, therefore, writ petition is not maintainable at this stage. 4. Heard learned counsel for the parties and perused the order dated 12.08.2025 (Annexure P-1) including the writ petition. 5. Relevant portion of order Annexure P-1 reads as under:

6. In view of above, it is crystal clear that while passing the order dated 12.08.2025 (Annexure P-1) no reasons has been assigned by the
4 Commissioner and respondent No.5 was not present at that time and notice has not been given to him. 7. For the foregoing reasons/discussion, this writ petition is disposed of permitting the petitioner to again file an application under Section 52 of the Chhattisgarh Land Revenue Code, 1959 before the concerned Commissioner and in-turn the Commissioner shall consider and decide the same in accordance with relevant rule/law/regulation after giving proper opportunity of hearing to the petitioner as well as respondent No.5. 8. It is made clear that this Court has not expressed any opinion with regard to merits of the case. Sd/-
