[2025:RJ-JP:33610-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. State Of Rajasthan, Through Principal Secretary, Medical And Health Department, Rajasthan, Jaipur. 2. Director, Medical And Health Service (Public Health), Swasthya Bhawan, Tilak Marg, C-Scheme, Jaipur (Raj.). 3. Additional Director (Administration), Medical And Health Department, Swasthya Bhawan, Tilak Marg, C-Scheme, Jaipur (Raj.). ----Respondents For Appellant(s) : Mr. Tanveer Ahmad For Respondent(s) : Mr. Vigyan Shah, AAG HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE BHUWAN GOYAL Order 25/08/2025 1. This appeal has been filed by the appellant against the order dated 05.03.2020 passed by learned Single Judge of this Court, whereby, the writ petition filed on behalf of the appellant-writ petitioner was dismissed. 2. In pursuance of the advertisement issued in the year 2018, the appellant-writ petitioner applied for the post of Women Health Worker. After verifying the documents of the appellant-petitioner, the respondents denied selection to her. [2025:RJ-JP:33610-DB] (2 of 3) [SAW-573/2020] 3. Being aggrieved of the action of the respondents, the appellant-petitioner filed a writ petition before the learned Single Judge which was dismissed vide order dated 05.03.2020. 4. Learned Single Judge while dismissing the writ petition filed on behalf of appellant-petitioner observed as under:- “3.Reply has been filed and respondent has come up with the stand that the selection process was conducted wherein verification was done of the documents of the candidates and as per the instruction booklet issued by the Board of Secondary Education, Rajasthan, Ajmer which mentions the equivalent recognised Xth Board examinations. It is found that the Xth class examination conducted by Mohali is not recognized by Board of Secondary Education as equivalent to Xth Class certificate issued by Board of Secondary Education, Rajasthan, Ajmer. 4. In view thereof, the petitioner has been held to be disqualified and her candidature has been rejected. In the opinion of this Court, the person who applies for the post has to pass Xth Board examination from a Board or Council which is declared as equivalent to the Xth Class Board examination conducted by the Board of Secondary Education, Rajasthan, Ajmer for the purpose of appointment in service in Rajasthan. 5. Accordingly, it is held that the petitioner does not possess Xth Class Certificate which can be said to be recognized as equivalent to Xth class examination conducted by the Board of Secondary Education, Rajasthan. Hence, the petitioner's candidature is found to be rightly rejected. No interference is made out. 6.The writ petition is accordingly dismissed.” 5. We are in complete agreement with the view taken by learned Single Judge as the Board from where the appellant passed her secondary school examination was not recognized by the Board of Secondary Education Rajasthan, Ajmer. We have [2025:RJ-JP:33610-DB] (3 of 3) [SAW-573/2020] considered the fact that no other documents were placed on record before the learned Single Jude with regard to recognition/equivalence of the Board from where the appellant passed her 10th class examination. We have also considered the fact that the advertisement in question relates to the year 2018 and the selection has already been completed in the year 2021. 6. In that view of the matter no case is made out for interference at this stage. Hence, this appeal is dismissed. (BHUWAN GOYAL),J (INDERJEET SINGH),J PAYAL DHAWAN /83
