October 24, 2025 Sl. No.47 Court No.6 s.biswas CO 3661 of 2025 Mohidur Rahaman vs. Mohammad Kasimuddin and others Mr. Arup Sarkar ... for the petitioner By the order impugned, the application filed by the petitioner praying for police help was rejected. The learned counsel appearing for the petitioner submits that in spite of the order of injunction passed by the learned Trial Judge, the opposite parties are carrying on with the construction work in violation of the order of injunction. It appears from the order dated August 20, 2025, that the Inspector-in-charge, Chanchal Police Station was directed to ensure that the interim order of injunction in the form of status quo dated 1st July, 2025 is obeyed by the plaintiff as well as defendant nos.1 and 2 in its letter and spirit. Learned advocate for the petitioner submits that in spite of the said direction, the police authorities are not taking any steps in terms of the order passed by the learned Trial Judge. It appears from the order-sheets annexed to this civil revisional application that 22nd December, 2025 has been fixed for filing report by the Inspector-in- Charge, Chanchal Police Station. 2 Since the learned Trial Judge has already passed an order directing the Inspector-in-Charge, Chanchal Police Station to ensure that the ad interim order of injunction is obeyed in its letter and spirit, C.O. 3661 of 20252 stands disposed of by directing the Inspector-in-Charge, Chanchal Police Station to comply with the order dated August 20, 2025 passed by the learned Trial Judge in Partition Suit No.201 of 2025, unless the same is modified or vacated by any competent court of law.
