ORAL ORDER
This petition is filed by accused No.1 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 / 438 of Code of Criminal Procedure praying to grant anticipatory bail in respect of Crime No.388/2025 of Byadarahalli Police Station, Bengaluru registered for offences punishable under Sections 500, 409 and 420 of Indian Penal Code.

learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, the petitioner was running a company wherein the first informant has invested money in the said company. - 3 -

Initially, the petitioner had paid profit and also paid salary for three months to the first informant. Subsequently, the said company incurred loss. Therefore, he did not pay the profit to the first informant. The petitioner has sustained loss and become insolvent and has filed insolvency proceedings in I.P.No.10/2021 on the file of Senior Civil Judge, Palamanaru. In the said petition, the first informant has been shown as respondent No.50 and he is stated to have invested Rs.15,00,000/- in the company of the petitioner. There are ninety four (94) respondents in the said insolvency petition. 4. He further submits that, the alleged transactions are between 01.08.2019 to 31.08.2021 and complaint has been filed on 20.08.2025 i.e., after four years and there is a delay in filing the complaint. The grievance of the first informant is of civil in nature and the first informant can avail remedy for recovery of money invested by him, by way of filing Civil Suit. The petitioner is ready to co-operate with the police in investigation. The

petitioner who is alleged to have committed similar offences registered in Crime No.474/2025 of Banasawadi Police Station, Bengaluru has been granted anticipatory bail in the Sessions Court. With these, he prayed to allow the petition. 5. Per contra, learned High Court Government Pleader would contend that, the first informant believed the words of the petitioner herein, has invested huge money in the company of the petitioner with a hope of getting profit for the investment. The petitioner had paid profit for some months to the first informant and subsequently, the petitioner cheated the first informant in not paying the profit and not repaying the amount invested. The petitioner is required for custodial interrogation. With these, he prayed for rejection of the petition. 6. Having heard the learned counsels appearing for the parties, this Court has perused the FIR, complaint and other materials placed on record. - 5 -

On perusal of the FIR, it is clear that, the first informant has invested money in the company of the petitioner herein and he has been paid profit for his investment for six months and also paid salary for three months as he has been appointed as Company State Head in the said Company. As the petitioner subsequently did not pay the profit and not repaid the amount invested, a complaint came to be registered. The petitioner had filed insolvency proceedings which is pending in I.P.No.10/2021 on the file of Senior Civil Judge, Palamanaru against ninety four (94) persons. Among them, the first informant is arrayed as respondent No.50 in the said petition. On perusal of copy of the said petition, the first informant who is arrayed as respondent No.50 is stated to have invested Rs.15,00,000/- and share bond to that amount has been issued to him. Considering the said aspect, whether the petitioner herein has cheated the first informant is a matter of investigation. The offences alleged against the petitioner is not punishable either with death or

imprisonment for life. The petitioner has undertaken to co-operate with the police in investigation. 8. Considering all the above said aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, I pass the following:
ORDER This Criminal Petition is allowed. The petitioner is granted anticipatory bail in Crime No.388/2025 of Byadarahalli Police Station and is ordered to be released on bail, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Investigating Officer. ii) The petitioner shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond and furnish surety.

iii) The petitioner shall cooperate with the Police in investigation and make himself available for interrogation whenever required. iv) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. v) The petitioner shall appear before the Investigating Officer whenever summoned. vi) The petitioner shall appear before the Investigating Officer on 1st and 3rd Sunday of every month for a period of three months or till filing of the final report whichever is earlier.
