1. Heard Mr. Sanjay Agrawal, learned counsel for the petitioner. Also heard Mr. Sangharsh Pandey, G.A for the respondents/ State.

2 i. This Hon'ble Court may kindly be pleased quash/set-aside the impugned first information report (F.I.R.) No. 302/2023 registered at Police Station Ambikapur district Surguja (CG.) dated 16/05/2023 for offences under section 420, 34 of Indian Penal Code, in the interest of justice. ii. This Hon'ble Court may kindly be pleased to quash/set-aside the entire Chargesheet 254/2025 filed on 16.06.2025 for offences under section 420, 120b, 506 Indian Penal Code, in the interest of justice. iii. This Hon'ble Court may kindly be pleased to quash/set-aside the order taking cognizance dated 17/06/2025 by the Judicial Magistrate First Class Ambikapur, District Surguja (C.G.) iv. This Hon'ble Court may kindly be pleased to quash/set-aside the entire criminal proceedings of the criminal case no. 4754/2025, (state of C.G. Vs Rahul Aggarwal and others pending before the Judicial Magistrate First Class Ambikapur, District Surguja (C.G.), in the interest of justice.

Learned counsel for the petitioner submits that the case of co- accused was decided by this court bearing CRMP No. 2415 of 2025, wherein the petitioners were directed to file the compromise
3 documents along with proper application before the Court concerned and the Court concerned shall decide the same. When the counsel for the petitioner was called upon to show the copy of the order of this court, he submits that the order has not been filed. This omission reflects that the petition, as drafted by the
learned counsel for the petitioner in a casual manner.
4. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition with complete documents.
5. Learned State counsel has no objection.
6. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for, subject to depositing a sum of Rs. 5,000/- as cost by the petitioner in the Registry of this Court for wasting precious time of the court and producing the receipt of the same at the time of filing of the fresh petition, if any. The said amount shall be transmitted to the Special School for intellectually Handicapped Girls, District Narayanpur C.G.
