No. 23 of 2025 registered with Jath Police Station, District Sangli for offences punishable under Sections 334(1) and 305(a) of Bhartiya Nyay Sanhita, 2023. 2. It is the prosecution’s case that applicant and co-accused stolen sheeps and goats of the first informant. 3. It is the contention of learned counsel for applicant that applicant’s name is mentioned in the F.I.R. on the basis of statement of the co-accused. Applicant has no antecedents. It is the contention of learned APP that applicant and co- accused stolen sheeps and goats of the first informant and other persons. Considering the allegations against the applicant, his custodial interrogation is required. Hence, requested to reject the application. 5. I have heard both learned counsel, perused F.I.R. and documents produced on record. F.I.R. was lodged against unknown persons. In investigation, police involved the applicant in the present crime on the basis of statement of co-accused. The co-accused has been arrested and amount of goats and sheeps is recovered. 6. Considering these facts, custodial interrogation of the applicant is not required and I pass following order: O R D E R I. The Application is allowed. II. In the event of arrest, the applicant be enlarged on bail in C.R. No. 23 of 2025 registered with Jath Police Station, District Sangli on furnishing P.R. Bond in the sum of Rs. 20,000/- with Iresh 2/3 53-ABA-2320-2025 (CR).doc one or two sureties in the like amount. III. The applicant shall attend the concerned police station as and when required. IV. The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. V. Application is disposed of in above terms. VI.
