THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.31694 OF 2025 ORDER:
1. The petitioner has filed the present writ petition aggrieved by the observations of the 3rd respondent hospital, whereby the petitioner is required to submit no objection certificate from her husband or to get approval from higher authority for donating a portion of her liver to her brother.
2. The petitioner has minor children and their names also mentioned in the impugned letter. The 3rd respondent has called upon the petitioner to submit no objection certificate either from her husband or higher authority.
3. The learned Assistant Government Pleader for Medical and Health submits that the office of the 3rd respondent is situated in Hyderabad and the 3rd respondent is the organ transplant center. It is further submitted that as per Section 13 of the Andhra Pradesh Transplantation of Human Organs Act, 1995, the appropriate authority would have to approve the proposed organ donation by the petitioner.
4. The learned counsel for the petitioner submits that any delay in securing such approval may be fatal to the recipient.
5. Recording the submissions of the learned counsel for the petitioner, the petitioner would have to approach the competent authority in the State of Telangana and seek approval.

6. Needless to mention that the competent authority shall endeavour to pass appropriate orders as expeditiously as possible keeping in view the exigency involved.
7. Accordingly, the writ petition is disposed of. No costs.
8. Pending miscellaneous petitions, if any, shall stand closed.
