Counsel appearing on behalf of Sri Venkata Rama Rao Kota, Ld. Counsel for the Revision Petitioner and Sri Challa Ajay Kumar, Ld. Counsel for the Respondent. 2. The Respondent herein has filed E.A.No.182 of 2022 in O.S.No.10 of 2013 seeking information with regard to the assets possessed by the Judgment Debtor for the purpose of filing Execution Petition for execution of the Decree and Judgment in O.S.No.10 of 2013. The Revision Petitioner herein (Defendant/Judgment Debtor) had filed the Affidavit (page 17 of the Affidavit in this C.R.P) on 23.06.2025 before the trial Court. The Respondent herein (Plaintiff/Decree Holder) had filed Objections on 30.06.2025 to the list of the properties furnished by the Revision Petitioner herein (Defendant/ Judgment Debtor). 3. Having considered the same, the Judge, Family Court-cum-ll Additional District Judge, Srikakulam had passed an Order directing the Revision Petitioner herein (Defendant/Judgment Debtor) to be detained in Civil prison for a period of one month or until the amount is paid by the Respondent to the Petitioner for disobeying the orders of this Court. Ld. Judge, Family Court-cum-ll Additional District Judge, Srikakulam by observing in Para No.8 of the Order that the Revision Petitioner herein is intentionally not filing the complete particulars of the assets, liabilities, expenditure and bank statements in spite of giving number of opportunities to him. 4. The Judgment Debtor has challenged the Docket Order since detailed Order was not made available to him. The Detailed Order has been placed on record by way of Memo on 21.08.2025. Vide Order dated 3 07.12.2025, my predecessor, having considered the facts of the case, was pleased to stay the impugned Order. 5. During the pendency of the present Civil Revision Petition, the Judgment Debtor has filed a fresh Affidavit before the trial Court on 04.09.2025 vide G.R.No.1178/2025. A copy of the said Affidavit has also been placed on record vide Memo dated 11.09.2025. 6. Sri Challa Ajay Kumar, Ld. Counsel for the Respondent has raised objections as regards the correctness of the second Affidavit filed by the Judgment Debtor. 7. Having considered these rival submissions, this Court deems it appropriate to allow this Civil Revision Petition by setting aside the impugned proceeding of the Judge, Family Court-cum-ll Additional District Judge, Srikakulam dated 28.07.2025 in E.A.No.182 of 2022 in O.S.No.10 of 2013. Ld. Judge, Family Court-cum-ll Additional District Judge, Srikakulam is directed to consider the fresh Affidavit filed by the Revision Petitioner herein on 04.09.2025 vide G.R.No.1178/2025 and pass fresh Orders on merit after considering the objections raised by the Plaintiff/Decree Holder. 8. There shall be a further direction to the Ld. Judge, Family Court- cum-ll Additional District Judge, Srikakulam to dispose of the E.A.No.182 of 2022 in O.S.No.10 of 2013 within a period of six (06) weeks from the date of uploading of this Order on the web-site of this Court. 9. With these observations and directions, this Civil Revision Petition stands allowed. No order as to costs. 10.
