2 The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 & 2 for granting of pre-arrest bail in connection with Crime No.143 of 2025 of V.Kota Urban Police Station, Chittoor District, registered for the alleged offence punishable under Section 194 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’). 2. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. 3. As seen from the record, one G.Gangojiappa Gauda made one sincere attempt to commit suicide on 20.07.2025, that was not materialized. He mentioned in that suicide note that he was being betrayed by the petitioners and other persons, that they had fabricated some false accounts in unison and demanded G.Gangojiappa Gauda to pay Rs.45,00,000/- to Rs.50,00,000/- unnecessarily. 4. G.Gangojiappa Gauda again wrote a suicide note (2nd suicide note) on 01.10.2025 addressed to the Circle Inspector, V.Kota Urban Police Station, mentioning six persons’ names including the present petitioners, alleging that they created some false accounts. It was further mentioned that when G.Gangojiappa Gauda asked about the accounts for Rs.1,88,00,000/-, the petitioners and other accused harassed him mentally and also used criminal force against him. The petitioners and other accused created certain fabricated accounts and showed that G.Gangojiappa Gauda is liable to pay
3 Rs.45,00,000/- to Rs.50,00,000/- to them. G.Gangojiappa Gauda finally attributed that the petitioners are sole responsible persons for his suicide. 5. The petitioners are permanent residents of V.Kota Town and Mandal, Chittoor District. They have got fixed abode. After the de-facto complainant lodged a report with police, the police have registered FIR for the offence punishable under Section 194 of ‘the BNSS’. So far 4 witnesses are examined.

Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioners/Accused Nos.1 & 2, this Court is inclined to grant pre-arrest bail to the Petitioners/Accused Nos.1 & 2. 7. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioners/Accused Nos.1 & 2, they shall be enlarged on bail subject to them executing a self-bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. ii. The Petitioners/Accused Nos.1 & 2 shall make themselves available for investigation as and when required. iii. The Petitioners/Accused Nos.1 & 2 shall not cause any threat, inducement or promise to the prosecution witnesses. iv. The Petitioners/Accused Nos.1 & 2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. 4 v. The Petitioners/Accused Nos.1 & 2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioners/Accused Nos.1 & 2 shall surrender their passports, if any, to the investigating officer.
