The Court made the following ORDER:
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A6, seeking regular bail, in Crime No.174 of 2023 of Makavarapalem Police Station, Anakapalli district. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections

20(b)(ii)(C), 22 (C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 27.08.2023, at about 10.00 AM, on credible information about transportation of Ganja, the Sub-Inspector of Police, Makavarapalem Police Station, along with his staff and mediators, rushed to main road near RTC Complex, Makavarapalem and, while conducting vehicle checking, he found one Safari white colour Car bearing registration No.KL 16 E 0582 coming from Narsipatnam and proceeding towards Tallapalem. On seeing the police, three persons got down from the vehicle and tried to escape. Then the Sub-Inspector of Police with the assistance of his staff apprehended them. During the course of interrogation, A1 to A3 disclosed their address particulars and, based on their confessional statements, the police seized 20 Kgs of liquid ganja and 20 Kgs of dry ganja from the possession of A1 to A3 kept in gunny bag in plastic drum, which was loaded in the said Car dickey, in the presence of mediators under cover of a mediators report and a case has been registered against the accused. A1 to A3 confessed about the involvement of A4 to A6 in the

present crime. Petitioner herein/A6 was arrested and remanded to judicial custody on 21.10.2024. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 20 Kgs of liquid ganja and 20 Kgs of dry ganja were seized from the possession of A1 to A3 on the date of incident, which is a huge commercial quantity.
A1 to A3 confessed about the involvement of the petitioner herein/A6 and other accused in this crime. It is submitted by the learned Assistant Public Prosecutor that the case is still under investigation and other accused are yet to be arrested. This is the second bail application filed by the petitioner herein and the earlier bail application filed by him was dismissed by this Court on 27.12.2024. There are no changed circumstances for granting bail to the petitioner herein. 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A6. 7.
