THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 580 of 2025
ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Accused Nos. 3 & 4, seeking regular bail, in Crime No.70 of 2024 of Chintoor Police Station, Alluri Sitharama Raju District.
2. Case of the prosecution, in brief, is that on 17.09.2024 at about 07.00 PM, on credible information, the Sub-Inspector of Police, Chintoor Police Station, along with his staff and mediators, while conducting vehicle checking, found A3 and A4 in possession and illegal transportation of 100 kgs of Ganja in Swift Dzire Car bearing registration No. MH 12 GZ 7367. On interrogation, A3 and A4 confessed that they fetched the Ganja from A2 at the instance of A1 who provided the Car to bring the Ganja. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. A1 and A2 were absconding.
3. Heard the learned Counsel for the petitioners and learned Assistant Public Prosecutor representing on behalf of the State. Perused the record.

Learned Counsel for the Petitioners would submit that the Petitioners are entitled for statutory bail.

5. Learned Assistant Public Prosecutor would submit that the Petition may be disposed of giving liberty to the petitioners to move such application before the Special Court.
6. Considering the submissions made, the Criminal Petition is disposed of. However, the Petitioners are at liberty to file a petition before the Special Court and on filing such petition, learned Special Judge, is directed to dispose of the same as expeditiously as possible preferably on the very same date.
7. Accordingly, the Criminal Petition is disposed of.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
