Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 2. Petitioner is arraigned as accused No.1 in Crime No.91/2025 of Peenya Police Station, Bengaluru City, registered for offence Punishable under Section 12, 17 and 8 of the POCSO Act, 2012. 3. Complaint is lodged by one Kiran kumar, father of the victim girl. Accused No.2 is the complainant’s wife. It is alleged that the victim girl, aged about 8 years is

studying in 2nd standard. Complainant’s wife was earlier working in garments and since two years she is running a auto rickshaw. It is alleged that petitioner/accused No.1 befriended complainant’s wife and persuaded her to run auto rickshaw and thereafter, she was unnecessarily quarrelling with the complainant and she would even leave the house and stay elsewhere for two to three days and used to take their daughter with her. About 15 days prior, complainant’s minor daughter informed the complainant that the petitioner has sexually abused her by touching her chest, pinching her thigh etc., and when she had complained to her mother, she supported the petitioner. 4. It is alleged that petitioner has touched complainant’s minor daughter inappropriately and she disclosed the incident about 15 days prior to lodging of the complaint. It is alleged that the petitioner used to touch victim's chest, pinch her thigh etc. In the statement of the victim girl recorded under Section 183 of the BNSS, she has alleged that the petitioner has also assaulted her with

a belt on her nose. The said allegation is not found in the earliest version, when the complaint was lodged. 5. It is contended by the learned counsel that, on account of the close acquaintance between complainant's wife and petitioner and dispute between complainant and his wife, a false case is registered against the petitioner. 6. It is submitted that the victim girl has not given consent for medical examination therefore, no medical examination was conducted. 7. Police have filed charge sheet against accused Nos.1 and 2 for the offence Punishable under Section 8, 9(l), 9(m), 10, 17, 19 and 21 of the POCSO Act, 2012. Accused No.2 is complainant's wife.
She has been enlarged on bail. The allegations against petitioner have to be established during trial. Statement of the victim girl is already recorded under Section 183 of the BNSS, 2023. Petitioner is in judicial custody since 19.03.2025. Hence,

by imposing stringent conditions, petitioner can be released on bail. Accordingly, the following:-
ORDER i) Petition is allowed. ii) Petitioner/accused No.1 in Crime No.91/2025 of Peenya Police Station, Bengaluru City, pending in Spl.C.No.990/2025 on the file of the Court of Additional City Civil and Sessions Judge, FTSC-1, Bengaluru, shall be enlarged on bail, subject to following conditions:
1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall not threaten, intimidate or influence the victim or her family members either directly or indirectly.
3. He shall furnish proof of his residential address and shall inform

the Court, if there is change in the address.
4. He shall not directly or indirectly tamper with the prosecution witnesses.
5. He shall not indulge himself in committing any offence.
6. He shall appear before the trial Court regularly on all dates of hearing. Violation of any of the condition shall result in cancellation of bail.
